The Christmas holidays, in Texas, are divided in half by odd and even years. The non-custodial parent, in odd numbered years (2009), will have the right to possession of the child beginning at noon on December 26th (December 28th for newer orders) and ending at 6:00 p.m. on the day before school resumes after the Christmas School vacation or at the time school resumes for those who have standard extended possession. Remember that each non-custodial parent must check with the school district where the child resides to verify the date the school district recesses and resumes classes. Most Texas school districts recess for the Christmas holiday Friday, December 18th. December 18th is the 3rd Friday in December, which is a standard weekend possession for a non-custodial parent, however this year you will NOT get the third Friday in December because the 18th starts the 1st half of Christmas, which the custodial parent gets in 2009. It is very important to remember that you must knock on the custodial parents door, the right day and time, or at any other location for exchanging the child, as described in your court order. You will not be able to enforce the order if you don't follow the order. You should also check your court orders for the odd and even language. Fathers for Equal Rights will be open on Saturday, December 28th from 8:00 a.m to 5:00 p.m. and have both an attorney available and our document services. Writs of Habeas Corpus and Motions for Enforcement will be prepared, for members, on December 28th, for filing with the court on the next day.
